What Is the TPD and How Does It Apply in the UK?
The Tobacco Products Directive (TPD) is European legislation that was transposed into UK law as the Tobacco and Related Products Regulations 2016. Post-Brexit, the UK has maintained these regulations independently, with the MHRA (Medicines and Healthcare products Regulatory Agency) acting as the enforcement and notification body.
Every nicotine-containing vaping product sold in the UK must be notified to the MHRA before it can be placed on the market. The notification involves submitting detailed product information including ingredients, emissions data, and safety assessments. Products that haven't been notified are illegal to sell regardless of whether they meet the technical specifications.
The Key Technical Limits Every Retailer Must Know
Nicotine strength: maximum 20mg/ml. Any product containing nicotine above this concentration cannot legally be sold as a vaping product. Products marketed as 'salt nicotine' at 50mg/ml (common in some US-origin products) are not legal for UK retail.
Tank and cartridge capacity: maximum 2ml. This applies to all tanks, pods, and pre-filled cartridges. Products with larger capacities are non-compliant. Check this on every new product line you consider stocking.
E-liquid bottle size: maximum 10ml for nicotine-containing liquids. Shortfill bottles (0mg nicotine, sold unfilled) can exceed this but cannot contain nicotine at the point of sale. Nic shots are sold separately and must themselves comply with the 10ml limit.
Child-resistant and tamper-evident packaging. All nicotine-containing e-liquids must have child-resistant closures and tamper-evident packaging. Products without this — often seen in very cheap imported stock — are non-compliant.
Ingredient restrictions. Vitamin E acetate, diacetyl, acetyl propionyl, and several other compounds are banned from UK e-liquids. Colouring agents in e-liquids are also restricted. Your suppliers should be providing ingredient compliance documentation.
What to Check When Taking on New Stock
Before adding any new product to your retail range, verify: the MHRA notification number (your supplier should be able to provide this for every product); UK-compliant nicotine strength labelling; tank/pod capacity within the 2ml limit; appropriate warning labels and health information in English; child-resistant packaging. Asking for this documentation from your supplier is standard practice for responsible retailers — any legitimate UK distributor will provide it without hesitation.
The Disposable Vape Ban and What It Means for Stock
As of June 2025, single-use non-rechargeable disposable vapes cannot be sold in England, Scotland, and Wales. Products that aren't rechargeable — regardless of TPD compliance in other respects — cannot legally be moved as retail stock. If you have remaining single-use disposable stock from pre-ban purchasing, you cannot legally sell it and should consult a legal professional on disposal options.
Rechargeable disposable formats (USB-C rechargeable devices with a pre-filled element) remain legal if TPD-compliant. Most of the major brands have rechargeable variants — Hayati, IVG, SKE Crystal, and others — that can be legally stocked.
Consequences of Stocking Non-Compliant Products
Trading Standards have powers to inspect, seize, and destroy non-compliant stock. There is no compensation for seized stock — it's a pure business loss. Civil penalties and prosecution are possible for persistent or deliberate non-compliance. Trading Standards can also require retailers to notify customers who may have purchased non-compliant products, which has reputational consequences.
